This Privacy Policy applies to, and only to, data collected through the Academy Collection platform (https://www.academycollection.org) (the “Site”).

The Academy of Motion Picture Arts and Sciences (“we” or “us”), the operator of the Site, is dedicated to preserving the privacy of data given to us by users of the Site.  A link to this Privacy Policy is set out in the footer information carried on every page of the Site.  Maintaining the privacy of data is important to us, informing our users of the types of information we collect, and how we treat it, is critical to our operation.  When you provide your personal information to us through the Site, that constitutes your agreement to the terms of this Privacy Policy. 

What types of personal information do we collect from you through the Site? Under this Privacy Policy, your “personal data” is any information that identifies you or makes you identifiable. The types of personal data we may collect and process about you include some or all the following:

  • Identity Information Most of the site is freely accessible without requiring a login.  To add items to a list, request a viewing or order a copy, we require you to create an account.  As part of creating this account, we ask for your first name, last name and email address. We also ask for additional optional data,  such as company/institution, address, phone number and preferred pronouns. 

  • Like most major websites, we use the following technologies to automatically collect certain additional information about you.
  • Log Files We collect your Internet Protocol (“IP”) address, which identifies the computer or service provider you use or, if you connect through a mobile device, your mobile device identifier, location information, date and time of access, browser type, referring/exit pages, and operating system. We use this data to administer the Site, provide support, track movement around the Site, analyze trends, and enhance security.
  • Cookies Cookies are small text files that can be used by websites to make a user’s experience more efficient. The Site uses cookies to manage user sessions when logged on to the site.

How do we use the information you provide? We use your personal data we gather when you create an account to contact you about requests you make to the Academy.

With what types of third parties do we share your information? The personal information you provide to us is accessible only by us and the third-party provider we use to host this platform.

We may use cookies (small data files deposited on your hard drive) which can make it easier for you to use the Site, and to personalize your experience.  Cookies cannot read other data from your hard drive, nor can they read data from other cookies that may reside on your hard drive.  If you are concerned about the use of cookies, you may wish to learn about the features in your browser that permit it to notify you whenever a cookie is deposited or allow you to reject cookies entirely. While most features of the Site will function properly without cookies, there may be some degradation in your experience if you reject cookies.  For that reason, we suggest that you not reject cookies.

We also use web beacons (a sometimes-transparent pixel-size graphic image on your monitor, also known as a GIF or a pixel tag) to monitor user behavior.  Web beacons can be used to identify which parts of the Site you have visited.  Neither cookies nor web beacons contain any personal information about you.  We can use cookies and web beacons to analyze traffic on the Site, to improve content and navigation, to enhance marketing, to personalize your experience. 

Finally, we share your information when we believe we have a legal obligation to do so. 

Does the Site employ any third parties to collect your personal information across time and space? We engage third-party vendors to help us operate the Site. We believe this partner to be reputable and capable. Our agreements with the third party described contain terms, as appropriate, requiring them to treat your personal data in accordance with this Privacy Policy.

Our Platform may provide links to other (third-party) websites and apps for your convenience or information. Linked sites and apps have their own privacy notices or policies, which we strongly encourage you to review. To the extent any linked websites or apps are not owned or controlled by us, we are not responsible for their content, any use of the websites or apps, or the privacy practices of the websites or apps. 

How do we respond to Do-Not-Track requests? The Site does not respond to a browser's "Do Not Track" signal.

What type of protection do we offer for your information? We take appropriate administrative, technical, and physical measures to protect your personal data from loss, theft, and unauthorized use, disclosure, or modification.

No data transmission over the Internet is 100% secure. While we strive to protect your personal data, we cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk. We use various tools (usernames, passwords, encryption, security systems, etc.) to protect it against unauthorized access, use, and disclosure. Nevertheless, unauthorized interception of transmissions of your personal data, or unauthorized access to it in storage, is possible. Therefore, although we strive to protect your privacy, we cannot promise that your personal data will invariably remain private. Further, users are responsible for safeguarding the confidentiality of their account information, including the username and password to access the site. Please do not share such account information or passwords with anyone and remember to log out when you are not using the Site to prevent unauthorized access.

What Rights Are Provided Under The GDPR? The European Union’s General Data Protection Regulation (“GDPR”) is a privacy law that affords certain rights relating to the personal data of individuals in the European Economic Area (“E.E.A.”). Specifically, if you are in the E.E.A., you have a right to learn from us whether we are processing your personal data, our purposes in doing so, how your personal data was obtained (if you did not provide it to us directly), who it may have been shared with, and how long it will be retained. Further, you have the right to request your personal data be corrected if it is inaccurate and, in certain circumstances, may ask that it be erased, you may withdraw your consent to any processing whose legal basis is consent, and you may object to further processing. Finally, subject to certain limitations, and when feasible, you may request a copy of your personal data or that it be transferred in portable electronic form to another entity. You will not typically need to pay a fee to exercise any of these rights. But we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive. Alternatively, we may refuse to comply with your request in these circumstances. If you are located in the E.E.A. and have a concern about our processing of your data, you should contact us at support@oscars.org. Also, you have the right to make a complaint to the appropriate supervisory authority in the E.E.A. For the personal data that we collect from you, we act as a “controller” under the GDPR. As discussed above, we use data for a variety of different purposes. Under the GDPR we are required to have a lawful basis for all processing. Most of the time, that lawful basis will either be to (1) perform a contractual obligation we have with you, (2) fulfill our legitimate interests, (3) comply with a legal obligation, or (4) conduct processing to which you have specifically consented. Your personal data may be transferred to our servers in the United States. Because the United States has not received an “adequacy” finding from the European Commission, we transfer your personal data only with your explicit consent (which you may withdraw at any time), or to perform our agreement with you.

How Long Do We Retain Your Personal Data? We keep your personal data within our collection management systems for historical record, and as required by any legal obligation to which we are subject.

How will you know if this Privacy Policy changes so as to become materially less restrictive? The effective date of the current Privacy Policy is posted at its beginning. We may modify this Privacy Policy at any time, from time to time, without notice. Modifications may be occasioned by changes in the services offered through the Site, changes in the law, changes in our internal decision-making process, or by other factors. Each such modification will be effective immediately upon posting the revised policy on the Site. You may wish to visit the policy from time to time to review the most recent version. If you have not visited the site since the effective date of the current Privacy Policy, then the policy has changed to become materially less restrictive since your last visit. In that event, your continued use of the Site will constitute your agreement to the terms of the new Privacy Policy with regard to all personal information that you have submitted or will submit to the Site.

Does this Privacy Policy cover websites linked to the Site? You may find on the Site links to other websites. We believe these transferee websites are operated by reputable organizations, but we have no control over them and are not responsible for their conduct. Accordingly, this Privacy Policy does not apply to these linked websites. In using such websites, you should read their privacy policies and terms of use.
